1. The Services & Tiers

BWU Uplink offers three operational tiers. Your rights, access, and feature set are dictated by the tier associated with your account:

• Free Tier ($0): Full core communication access — text channels, direct messages, friends, and voice calls — hosted on the operator's infrastructure. User and message data is maintained on the operator's server.
• Premium Subscription ($10/Month): A non-exclusive, non-transferable recurring upgrade to your account that unlocks the full feature set for the duration of the active subscription, including file and image uploads, GIFs, camera broadcasting, screen sharing, studio audio processing, the soundboard, and profile banners. Cancellation stops future charges; access continues until the end of the paid billing period, after which the account reverts to the Free Tier.
• Self-Host License ($49/Year): A non-exclusive, non-transferable, revocable annual license granting a single activation key that permits you to operate one independent BWU Uplink server instance on your own hardware or hosting. The key binds permanently to the first installation that activates it and validates against the operator's license authority on a recurring basis. The license auto-renews annually; a lapsed, canceled, or revoked license disables the licensed server. As the administrator of an independent instance, you assume full responsibility for that server and the data of any users you host on it.

2. Intellectual Property & Code Restrictions

All source code, compiled native binaries, UI frameworks, design assets, custom styles, and branding elements associated with the BWU Uplink ecosystem are the exclusive property of the developer.

• Users are strictly prohibited from decompiling, reverse-engineering, disassembling, attempting to derive source components from, or modifying the native compiled desktop client executable.
• Any detection of binary modification, license signature forgery, or unauthorized asset extraction will prompt the immediate and permanent revocation of system access without notice or financial recourse.

3. Third-Party AI Security & Data Waiver

To enforce robust operational protection, neutralize automated server raid vectors, and evaluate entry compliance, the infrastructure wires natively into third-party automated processing systems (specifically the Anthropic Claude API).

• By utilizing the service, you acknowledge that strict security events — such as new user verification queries, access anomalies, and moderation logs — will be passed securely to third-party endpoints.
• Commercial data agreements ensure that data transmitted through these security checks is never utilized to train consumer AI models. However, BWU Uplink assumes no liability for external API infrastructure outages, latency spikes, or third-party packet drops.

4. Strict Non-Refunds Policy

All monetization transactions — including recurring monthly Premium subscription charges, annual Self-Host License charges, and voluntary support contributions — are processed via Stripe as digital deliverables with immediate deployment.

• Because BWU Uplink provides a completely free evaluation tier allowing full validation of operating system compatibility, latency metrics, and hardware performance prior to purchase, all sales are final. No refunds, partial or full, will be processed under any circumstances.
• Initiating a fraudulent banking chargeback or payment dispute will result in the immediate termination of the associated user profile, removal of associated data, and permanent blacklisting from the service.

5. Disclaimer of Warranties ("As-Is" Status)

THE SOFTWARE AND SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY VARIETY, EXPRESS OR IMPLIED.

BWU Uplink explicitly disclaims all standard legal warranties, including implied warranties of merchantability, uptime execution, or compatibility targets. BWU Uplink does not promise that operational cycles will be perfectly unbroken or free from software anomalies. Download, deployment, and utilization of the software is done entirely at your own discretion and risk. You bear sole liability for data security, local hardware faults, or system corruption resulting from application use.

6. Solo Developer Acknowledgment & Bug Resolution Policy

BWU Uplink is independently engineered, scaled, and maintained by a solo software developer. By engaging with this software, you recognize that you are backing an independent project rather than a large corporate entity.

• Software Anomalies: Code flaws, unexpected operating system hitches, and edge-case exceptions are an inherent facet of continuous deployment and are to be expected.
• Engineering Priorities: Critical security gaps or macro infrastructure failures will always be prioritized for immediate correction. Conversely, minor visual inconsistencies, minor UI bugs, or obscure platform edge cases may require extended development cycles to clear.
• Downtime Indemnity: You agree that you will hold no claim to compensation or refunds during periods of application maintenance, delayed feature shipments, or solo developer availability updates.

7. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL THE DEVELOPER OR OWNER OF OUTPOST BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

This limitation encompasses losses relative to server profit loss, operational data leakage, corporate downtime, hardware failures, or network disruptions, even if previously informed of such risks. In territories where liability exclusions are capped by statutory consumer law, total cumulative liability for all claims shall be explicitly limited to the total fees paid by you to BWU Uplink in the three (3) consecutive months immediately preceding the formal dispute filing.

8. Prohibited Activities & Absolute Legal Compliance

The operational license to access BWU Uplink is conditional upon complete adherence to international, federal, and local statutes.

• Illicit Frameworks: You strictly agree that you will not employ BWU Uplink to execute, orchestrate, or facilitate criminal operations. Forbidden acts include network cyberattacks, malware orchestration, financial fraud, illegal marketplace operations, systematic harassment, copyright theft, or the storage/delivery of illicit assets.
• User Responsibility: You are responsible for the content you post, upload, and share. If you use the service to break external laws, you assume 100% of civil, criminal, and structural liabilities arising from your own conduct.
• Sovereign Infrastructure Liability: For operators running an independent server under a Self-Host License, you acknowledge you are the absolute administrator of your own computing environment. BWU Uplink does not log, watch, or parse data on private self-hosted machines. If you use your private system to break external laws, you assume 100% of civil, criminal, and structural liabilities.

9. Automated Moderation & Mandatory Law Enforcement Reporting

BWU Uplink enforces a strict zero-tolerance approach regarding criminal operations hosted on the service.

• Moderation Logs: We maintain basic, in-app report triggers to review data stored on the service. We retain the right to drop profiles, purge violating message data, or isolate accounts that compromise system integrity.
• Mandatory Law Enforcement Inquiries: If we receive explicit confirmation or validated reports indicating that the service is hosting severe criminal operations, we will immediately freeze the offending accounts and proactively relay all data logs, IP footprints, and user profiles to appropriate law enforcement agencies.
• Waiver of Privacy Upon Abuse: Your data privacy expectations are immediately waived if you convert the service into a medium for criminal activities.
• Self-Hosted Boundary Notice: BWU Uplink possesses no technical method to inspect, moderate, or pull data logs from private, self-hosted instances. Legal actions regarding independent, self-hosted systems must be filed against the respective network operator or the underlying infrastructure hosting provider, not against BWU Uplink or its developer.

10. Binding Arbitration & Class Action Waiver

THIS SECTION STRICTLY CONDITIONS YOUR LEGAL REMEDIES. PLEASE READ CAREFULLY AS IT ELIMINATES YOUR OPTION TO FILE A FORMAL LAWSUIT INSIDE A COURT OF LAW.

• 10.1 Individual Arbitration: You agree that any operational dispute, breach claim, or legal disagreement connected to this software shall be addressed solely via binding, individualized arbitration managed by neutral private legal arbiters, rather than before a judge or traditional jury.
• 10.2 Class Action Waiver: ALL DISPUTE MANAGEMENT MUST BE INITIATED ENTIRELY ON AN INDIVIDUAL CAPACITY. YOU EXPLICITLY WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF, ACCUSER, OR CLASS MEMBER IN ANY CONSOLIDATED, REPRESENTATIVE, OR CLASS ACTION PROCEEDING.
• 10.3 Formal Opt-Out Right: You have a window of thirty (30) calendar days from your initial installation or registration to step outside this arbitration framework. To do so, you must deliver an explicit written opt-out notification to the operator. Passing this 30-day timeline establishes this waiver as fully binding.

11. Governing Law

These Terms, and all operational claims arising from your interaction with BWU Uplink, shall be evaluated and interpreted in strict accordance with the laws of the base jurisdiction where the primary developer resides, omitting any choice-of-law or legal conflict criteria.
