The Plain-English Summary (TL;DR)

We promise to keep BWU Uplink lightning fast, private, and 100% free of corporate bloat. In return, we ask that you use our software legally, don't copy or reverse-engineer our desktop client, and don't blame us if something goes offline. If there is ever an issue, reach out directly so we can resolve it quickly as normal people instead of involving lawyers. The formal legal boundaries are detailed below.

BWU Uplink offers three operational tiers. Your rights, access, and feature set are dictated by the tier associated with your account:

2. Intellectual Property & Code Restrictions

All source code, compiled native binaries, UI frameworks, design assets, custom styles, and branding elements associated with the BWU Uplink ecosystem are the exclusive property of the developer.

3. Third-Party AI Security & Data Waiver

To enforce robust operational protection, neutralize automated server raid vectors, and evaluate entry compliance, the infrastructure wires natively into third-party automated processing systems (specifically the Anthropic Claude API).

4. Strict Non-Refunds Policy

All monetization transactions — including recurring monthly Premium subscription charges, annual Self-Host License charges, and voluntary support contributions — are processed via Stripe as digital deliverables with immediate deployment.

5. Disclaimer of Warranties ("As-Is" Status)

THE SOFTWARE AND SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY VARIETY, EXPRESS OR IMPLIED.

BWU Uplink explicitly disclaims all standard legal warranties, including implied warranties of merchantability, uptime execution, or compatibility targets. BWU Uplink does not promise that operational cycles will be perfectly unbroken or free from software anomalies. Download, deployment, and utilization of the software is done entirely at your own discretion and risk. You bear sole liability for data security, local hardware faults, or system corruption resulting from application use.

6. Solo Developer Acknowledgment & Bug Resolution Policy

BWU Uplink is independently engineered, scaled, and maintained by a solo software developer. By engaging with this software, you recognize that you are backing an independent project rather than a large corporate entity.

7. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL THE DEVELOPER OR OWNER OF OUTPOST BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

This limitation encompasses losses relative to server profit loss, operational data leakage, corporate downtime, hardware failures, or network disruptions, even if previously informed of such risks. In territories where liability exclusions are capped by statutory consumer law, total cumulative liability for all claims shall be explicitly limited to the total fees paid by you to BWU Uplink in the three (3) consecutive months immediately preceding the formal dispute filing.

8. Prohibited Activities & Absolute Legal Compliance

The operational license to access BWU Uplink is conditional upon complete adherence to international, federal, and local statutes.

9. Automated Moderation & Mandatory Law Enforcement Reporting

BWU Uplink enforces a strict zero-tolerance approach regarding criminal operations hosted on the service.

10. Binding Arbitration & Class Action Waiver

THIS SECTION STRICTLY CONDITIONS YOUR LEGAL REMEDIES. PLEASE READ CAREFULLY AS IT ELIMINATES YOUR OPTION TO FILE A FORMAL LAWSUIT INSIDE A COURT OF LAW.

11. Governing Law

These Terms, and all operational claims arising from your interaction with BWU Uplink, shall be evaluated and interpreted in strict accordance with the laws of the base jurisdiction where the primary developer resides, omitting any choice-of-law or legal conflict criteria.
